Article 1: Presentation
These general conditions of sale apply to all bookings made as of September 4, 2019.
They cancel and replace all previous versions of general and special sales conditions proposed by the Center-Var Tourist Train Association.
The ATTCV reserves the right to modify its general conditions of sale at any time.
Article 2: Contractual relations
The information communicated concerning traffic, the planned rolling stock, the lines borrowed and the schedules are by nature subject to an important hazard largely escaping the control of the ATTCV and dependent on third parties such as SNCF Réseau and thus the contractual commitment ATTCV is to use its best efforts to ensure the trip to the specified destination on the day indicated.
The information on the ATTCV website and brochures may be subject to change. These changes will be announced on the website, booking page and on social networks. The customer already registered will be informed by message sent to the email address provided.
Except for regular trains, the payment is obligatory within a certain time after the order to validate the reservation. If this deadline is not respected, the order is automatically canceled. The customer will be able to redo a new order, within the limits of available places. The time is specified on the page dedicated to the trip and the mail sent to the customer.
Right of withdrawal
Pursuant to Article L 12 21-8 12 ° of the Consumer Code, the services offered by the ATTCV, as leisure activities that must be provided at a specific date or period, are not subject to the application of the right of retraction provided for in Articles L 121-21 et seq. of the same Code in the matter of distance and off-premises contracts.
Article 3: Cancellation or modification by the association
The association reserves the right to cancel the trip in the event of technical hazards beyond its control, or if the minimum number of participants has not been met within the deadline. Only the reimbursement of the sums paid may be claimed, to the exclusion of any other indemnity or compensation.
The association reserves the right to modify the trip in case of force majeure or circumstances beyond its control. No compensation or compensation can be claimed.
Article 4: Cancellation or modification by the client
A reservation may be modified (change of date, time, number of passengers, type of tour) without charge and without limit, since it has not given rise to any payment from the client .
If the customer has paid for the trip in whole or in part, he may request, no later than the day before the departure date originally planned, the postponement or exchange, with the possible application of a rate adjustment. This request will be made within the limits of available places.
Any customer can cancel his reservation in writing (mail or postal mail). Cancellations by phone are not accepted. No cancellation is accepted after the eve of departure at 17:00.
Except in cases of force majeure (illness, accident ...), the customer is refunded by check within 15 days after cancellation, with payment of fees:
